CONDITIONS OF ENTRY
RADIANT MICRO MAX CASH BACK PROMOTION
1. Information on how to enter and cash backs form part of these Conditions of Entry. Entry into this promotion is deemed acceptance of these Conditions of Entry by each entrant.
2. Entry is free and only open to residents of Australia who purchase a Qualifying Radiant Micro Max 1KG laundry powder product (as defined below) from a participating store during the promotional period. The directors, management and employees (and their immediate families) of the Promoter, its related entities, printers, suppliers, providers and agencies associated with this promotion are ineligible to enter the promotion. Qualifying Radiant Micro Max 1KG laundry powder products are:
a. Radiant Micro Max Top Loader High Performance 1KG;
b. Radiant Micro Max Top Loader Colour Care 1KG;
c. Radiant Micro Max Front Loader & High Efficiency High Performance 1KG; and
d. Radiant Micro Max Front Loader & High Efficiency Colour Care 1KG.
3. To enter the promotion, eligible entrants must:
a. first, purchase a Qualifying Radiant Micro Max 1KG laundry powder product (as outlined above) from a participating store during the promotional period; and then
b. submit their entry to the Promoter by mailing in a stamped envelope:
i) their full details (first name, surname, postal address, telephone number, mobile telephone number (if applicable)), and
ii) a photocopy of their original store receipt, to PO Box 566, Eastern Suburbs MC, NSW 2004. All required documentation must be sent together in one stamped envelope and received by the Promoter by 5:00pm on 30/6/2009, otherwise the entrant’s entry will be deemed invalid.
4. Entries will only qualify for the cash back if their entry is one of the first 10,000 eligible entries received and validated by the Promoter.
5. Entrants can only participate in their own name. Only one (1) entry per entrant is permitted. Any subsequent entry after the first valid entry received from an eligible entrant will be invalid. Entries received will be considered final by the Promoter. Incomplete, inaccurate, erroneous, ineligible or incomprehensible entries will be deemed invalid. Entries must be received in accordance with the timeframes outlined above, otherwise the entry will be deemed invalid. The Promoter accepts no responsibility for late, lost or misdirected entries.
6. Promotion commences at 9:00am (AEST) on 13/4/2009 and closes at 5:00pm (AEST) on 15/6/2009, and all entries must be received by the Promoter by 5:00pm on 30/6/2009. Winners will be notified by mail. Unsuccessful entrants will not receive a response. All reasonable steps to notify winners will be taken by the Promoter. The Promoter’s decision in relation to all aspects of the promotion is final and no correspondence will be entered into.
7. The first ten thousand (10,000) eligible entries received and validated by the Promoter will each receive one (1) cheque made payable to the winner in the sum of the amount they paid for the Qualifying Radiant Micro Max 1KG laundry powder product (as provided on their receipt). The maximum amount of the cheque is $10.49 (including GST). Cheques will be sent to winners within six (6) weeks of the date their entry is validated by the Promoter.
8. The total maximum cash back pool value is up to $104,900.00 (including GST). The cash backs are not transferable or exchangeable. The cash backs must be taken as offered and cannot be varied. The Promoter accepts no responsibility for any variation in cash back value. The Promoter accepts no responsibility for any tax implications that may arise from the cash backs. Independent financial advice should be sought.
9. The Promoter reserves the right to verify an entry with the store that issued the relevant purchase receipt.
10. Entrants can only enter in their own name. The Promoter reserves the right to request all entrants to produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm each entrant’s identity, age, residential address and email address, eligibility to enter and claim a cash back and any information submitted by the entrants in entering the promotion, before issuing a cash back. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or an entry has not been verified or validated to the Promoter’s satisfaction within the time requested, that entrant’s entry will become invalid.
11. The cash backs will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.
12. The Promoter reserves the right to reclaim the cash back from any entrant if Qualifying Radiant Micro Max 1KG laundry powder product is returned after the entrant’s entry has been processed and the cash back has been dispatched.
13. The Promoter and its associated agencies and companies shall not be liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person's negligence) in connection with using any cash back, except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). The Promoter and its agents associated with this promotion take no responsibility for cheques damaged or lost in transit.
14. The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for tampering with the entry process or for submitting an entry which is not in accordance with these Conditions of Entry, or if the entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
15. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter.
16. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration or compensation for the purpose of promoting, publicising or marketing this promotion (including any outcome), and promoting any products or services manufactured, distributed and/or supplied by the Promoter. The winners agree to participate in all reasonable promoted activities in relation to the Promotion as requested by the Promoter and its agents.
17. All entries and any copyright subsisting in the entries become and remain the property of the Promoter. The Promoter collects personal information about entrants to include entrants in the promotion and where appropriate award cash backs. If the personal information requested is not provided, the entrant may not participate in the promotion. By participating in the promotion, each entrant also acknowledges that a further primary purpose for collection of entrants’ personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and to contact entrants in the future with information on special offers or provide entrants with marketing materials via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future. The Promoter may share information with its Australian related companies and promotional partners who may contact entrants with special offers in this way. By entering the promotion, each entrant agrees that the Promoter may use entrants’ personal information in this manner. Each entrant also agrees that the Promoter may publish or cause to be published the winner’s name and locality in any media as required under the relevant lottery legislation. Entrants can also gain access to, update or correct any personal information by contacting the Promoter at the address below. All personal information will be stored at the office of the Promoter. A copy of the Promoter’s Privacy Policy in relation to the treatment of personal information collected may be obtained by contacting the Promoter.
